The constitution commands armed forces to 'obey lawful orders from the president'. Normally, presidents are careful to ensure that they are in line with the constitution when issuing orders, that is why they appear to be in full control of the armed forces. In reality, they don't! If a president blattantly issue an order in violence to the constitution, the armed forces will not obey. But this is often very rare, especially in US. Those who rule with an iron fists are often shrewd enough to appear as though they are in line with constitution so they may not divide the military.
But what if the military does obey an order that is in obvious violation of the constitution ( e.g a president is trying to exercise a power that is realy not given to him by the constitution). Then both the military leaders, together with the president becomes criminals! That is why both Saddam and the senior most military commander was sentenced to death! The military leader could not say 'he was obeying orders' because it is actually the constitution which you must obey, not the president.
